1. Who Is Responsible for Your Data?

DAKIMO has no establishment in the European Union. For professional buyers located in the EU, DAKIMO acts as data controller within the meaning of Article 3(2) GDPR whenever processing relates to offering goods or services (B2B wholesale) to individuals located in the Union.

2. What Data Do We Collect?

Through the “Request a Quote / Contact” form, the Site collects:

• Identity: first and last name
• Professional contact details: company, email address, country
• Request content: products of interest, free-text message

No sensitive data (within the meaning of Article 9 GDPR) is requested. No automated decision-making or profiling is carried out from this data.

3. Why Do We Use Your Data?

• Processing quote, sample and B2B introduction requests
• Establishing and following up the commercial relationship (contracts, orders, invoicing)
• Sending requested Technical Data Sheets (TDS), Certificates of Analysis (COA) and regulatory documents
• Meeting legal and customs obligations linked to export (batch traceability, market-specific regulatory compliance)

4. Legal Basis for Processing

• Steps taken at the data subject's request prior to entering into a contract (Article 6(1)(b) GDPR) — for quote requests
• Performance of a commercial contract (Article 6(1)(b)) — for buyers who become customers
• DAKIMO's legitimate interest in developing its B2B commercial relationships (Article 6(1)(f)), balanced against data subjects' rights
• Compliance with legal obligations (Article 6(1)(c)) — in particular customs and cosmetic-compliance obligations (EU CPNP, UK SCPN, US MoCRA, Health Canada)

5. Who Has Access to Your Data?

Your data is disclosed exclusively to:

• Authorized Dakimo Corporation SARL staff responsible for export sales and customer relations
• Where applicable, DAKIMO's technical service providers (site hosting, messaging tools) acting as processors within the meaning of Article 28 GDPR
• Freight forwarders, carriers and customs authorities, strictly to the extent necessary for international shipment of orders

DAKIMO does not sell or rent contact data to third parties for commercial purposes.

6. Transfers of Data Outside the European Union

As DAKIMO is established in Benin, any processing of data relating to individuals located in the European Union constitutes a transfer of data outside the EU within the meaning of Chapter V GDPR. This transfer is necessary for the performance of a contract entered into at the data subject's request (Article 49(1)(b) GDPR — quote requests, order placement and fulfilment). For any ongoing commercial relationship, DAKIMO undertakes to formalize this transfer using Standard Contractual Clauses (SCCs) approved by the European Commission, upon request from the EU-based customer.

7. Data Retention

• Quote requests with no resulting sale: 3 years from the last contact
• Active customer data: for the duration of the commercial relationship, plus applicable statutory limitation periods (commercial and accounting records: 10 years)
• Customs and regulatory documents (TDS/COA linked to shipped batches): the statutory retention period applicable to customs and cosmetic traceability requirements

8. Your Rights

In accordance with the GDPR (for individuals located in the EU) and applicable Beninese data protection law, you have the following rights over your data:

• Right of access and rectification
• Right to erasure (“right to be forgotten”), subject to DAKIMO's statutory retention obligations
• Right to restriction of processing
• Right to object, in particular to processing based on legitimate interest
• Right to portability of the data you have provided
• Right to lodge a complaint with the competent supervisory authority: your national data protection authority within the EU, or Benin's Data Protection Authority (APDP)

To exercise these rights, contact DAKIMO at dakimo1@yahoo.fr, specifying the purpose of your request and enclosing proof of identity if necessary. DAKIMO undertakes to respond within one month.

9. Cookies and Trackers

This Site, in its current form, does not use non-essential cookies. It may use strictly necessary technical cookies required for the Site to load and function correctly (for example, security or load-balancing cookies set by our hosting provider, Hostinger).

The Site loads web fonts directly from Google Fonts. In doing so, the visitor's browser may send its IP address to Google's servers to retrieve the font files; Google Fonts does not set cookies for this purpose when used in this standard way.

Should DAKIMO add tools that generate analytics, advertising or third-party cookies in the future (for example, an audience-measurement tool, a live chat widget, or a video embed), a cookie consent banner compliant with applicable law will be added to the Site and this section will be updated accordingly before those tools go live.

Note for DAKIMO: if a booking form, chat widget, analytics tool or advertising pixel is added later, this section must be updated first — and a consent banner put in place — before that tool is switched on.

10. Data Security

DAKIMO implements reasonable technical and organizational measures to protect collected data against loss, unauthorized access, disclosure or alteration, proportionate to the nature of the data processed (non-sensitive, B2B professional data).

11. Changes to This Policy

DAKIMO may amend this Privacy Policy from time to time, in particular to comply with regulatory or technical developments. The version in force is the one published on the Site at the time of consultation.
